Acceptance of the terms of the Agreement
1. Registration of the User on the Site means full and unconditional acceptance of this Agreement by the User.
2. The user is obliged to fully familiarize himself with this Agreement prior to registration.
3. This Agreement is a legally binding agreement between the User and Nethouse.id, the subject of which is the provision of software to the User, the provision of services for the use of the Site and its services (hereinafter referred to as the 'Services'), containing the rules and conditions for the provision and use of the Services . In addition to this Agreement, the agreement between the User and Nethouse.id includes all special documents regulating the provision of certain services of the Site and posted in the relevant sections of the Site.
4. This Agreement may be changed and/or supplemented by Nethouse.id unilaterally without any special notice. This Agreement is an open and public document.
5. The Nethouse.id Services are provided 'as is', including all scripts, applications, content and design of the Site. Nethouse.id disclaims all warranties that the Site or its services may or may not be suitable for a particular purpose of use. Nethouse.id does not represent or warrant that:
Registration on the Site
1. Registration of the User on the Site is free, voluntary and is performed on the Internet. Registration and authorization on the Site is carried out using connected social networks, based on the OpenID or OAuth protocol in accordance with the User's data access settings in the social network.
2. The user of the Site is an individual or his legal representative who has reached the age permitted in accordance with applicable law to accept this Agreement and has the appropriate authority, as well as legal entities registered on the Site.
3. When registering on the Site, the User is obliged to provide the Site Administration with the necessary reliable, up-to-date and complete information, including a login unique for each User (an email address to enter the Site) and a password for accessing the Site, as well as a last name and first name. The registration form of the Site and/or Nethouse.id may ask the User for additional information, which the User is obliged to provide. If the User provides incorrect information or the Site Administration has reason to believe that the information provided by the User is incomplete or unreliable, then Nethouse.id has the right, at its own discretion, to block or delete the User's page and refuse to provide the Services to the User.
4. The user is responsible for the accuracy, relevance, completeness and compliance with the law of the information provided during registration and its purity from the claims of third parties. Nethouse.id reserves the right at any time to require the User to confirm the data specified during registration, and to request supporting documents in this regard, the failure to provide which, at the discretion of the Site Administration, may be equated to the provision of false information.
5. After providing information at the request of Nethouse.id, the User must go through a number of authentication procedures, namely: a) confirm registration by recognizing an automated test designed to distinguish between computers and people ('captcha'); b) confirm their registration by activating the page through a message sent by Nethouse.id to the User's e-mail. In the case of the correct sequential execution of all registration actions on the Site, a User page is created. Words and names, the use of which is prohibited in accordance with these Rules, current legislation and international legal acts, including obscene language, names registered as trademarks (regardless of the class of the Nice Classification), company names cannot be selected as a subdomain name. and commercial designations, if the user does not own exclusive rights to them, but not limited to the above. In the event of a violation of these conditions, the Administration has the right to prohibit the User from using the subdomain name assigned to him, including, if applicable, transferring the right to use it to the appropriate person (representative of the right holder).
6. The login and password chosen by the User are necessary and sufficient information for the User to access the Site. The user does not have the right to transfer his login and password to third parties, is fully responsible for their safety, independently choosing the method of their storage. The user is solely responsible for the security (resistance to guessing) of the password he has chosen, and also independently ensures the confidentiality of his password.
7. Unless proven otherwise by the User, any actions performed using his login and password are considered to be committed by the corresponding User. In case of unauthorized access to the login and password and / or the User's page or distribution of the login and password, the User is obliged to immediately notify the Site Administration in accordance with the established procedure.
8. After registration, the User gets the right to independently create, use and determine the content of his own page.
9. The User, as the owner of the information posted on his own page, is aware that, with the exception of cases established by this Agreement and the current legislation of the Russian Federation, Nethouse.id does not take part in the formation and use of the content and control of other users' access to the User's page.
10. When creating and administering the page, the User confirms that he acts legally (for example, on the basis of a power of attorney), has all the necessary rights and does not violate by his actions the legal rights and interests of third parties, as well as the current legislation of the Russian Federation, including competition and intellectual property law.
11. The user is fully responsible for their actions related to the creation and administration of the page, in accordance with the current legislation of the Russian Federation.
12. If it is discovered that the User has violated the legitimate rights and interests of third parties and the current legislation of the Russian Federation, as well as the provisions of this Agreement, when creating and administering the page, Nethouse.id has the right to block the User's access to the page and / or transfer the rights to administer the page, in including the right to use the short name of the page (subdomain name), to the legal owner who has confirmed his rights to the content of the page in the prescribed manner.
13. User's password can be restored by Nethouse.id only if the information provided during registration with Nethouse is complete, correct and accurate. If the User has neglected the correct, accurate and complete indication of the registration information, Nethouse will not be able to recover the password upon request. Nethouse recommends that you keep your password safe and complete the Nethouse registration form correctly, accurately and completely.
User Responsibilities
1. When using the Site, the User must:
  1. Pay for the ordered services within a period not exceeding 1 (one) day from the expiration date of the previous payment. If the User fails to pay for the services, Nethouse.id suspends the provision of services in the amount determined by the tariff, service or option chosen by the User.
  2. Comply with the provisions of the current legislation of the Russian Federation, this Agreement and other special documents of the Site Administration.
  3. Provide accurate, complete and up-to-date data during registration, monitor their updating.
  4. Inform the Site Administration about unauthorized access to the page and/or unauthorized access and/or use of the User's password and login.
  5. Do not post on the page information and objects (including links to them) that may violate the rights and interests of others.
  6. Before posting information and objects (including images of other people, other people's texts of various contents, audio recordings and videos, but not limited to the above), pre-evaluate the legality of their placement.
2. If there is any doubt about the legality of the implementation of certain actions, including posting information or providing access, Nethouse.id recommends refraining from doing so.
3. When using the Site, the User is prohibited from:
  1. Register as a User on behalf of or instead of another person ('fake account'), while registration on behalf and on behalf of another individual or legal entity is possible, subject to obtaining the necessary authority.
  2. Upload, store, publish, distribute and make available or otherwise use any information that:
    - is vulgar or obscene, contains obscene language, contains pornographic images and text, or scenes of a sexual nature involving minors;
    - contains threats, discredits, offends, discredits the honor and dignity or business reputation or violates the privacy of third parties;
    - violates the rights of minors;
    - contains scenes of violence or inhumane treatment of animals;
    - promotes and/or incites racial, religious, ethnic hatred or enmity, promotes fascism or racial superiority;
    - promotes criminal activity or contains advice, instructions or guidelines for committing criminal acts;
    - contains extremist materials;
    - contains restricted access information, including, but not limited to, state and commercial secrets, third party privacy information;
    - contains advertisements for or describes the attraction of drug use, including 'digital drugs' (sound files that affect the human brain through binaural beats), information about the distribution of drugs, recipes for their manufacture and tips for using them;
    - is fraudulent;
    - contains information about the sale or method of acquiring goods and/or services whose distribution is prohibited in the Russian Federation, including information about the sale of alcohol, medicines, potent drugs, and also violates other rights and interests of citizens and legal entities or requirements legislation of the Russian Federation.
  3. It is illegal to upload, store, publish, distribute and make available or otherwise use the intellectual property of third parties.
  4. Make mass mailing of messages without the consent of the addressees.
  5. In any way, including but not limited to fraud, breach of trust, hacking, try to gain access to another User's login and password.
  6. Unlawfully collect and process personal data of others.
  7. To access (try to get) access to any Services otherwise than through the interface provided by Nethouse.id, unless such actions were expressly permitted to the User in accordance with a separate agreement with the Administration.
  8. Post any other information that, in the personal opinion of the Administration, is undesirable, does not correspond to the purposes of creating the Site, infringes on the interests of other Users or third parties, or for other reasons is undesirable for posting on the Site.
  9. Use domain names that are included in the Unified Register of Domain Names, Site Page Pointers on the Internet and Network Addresses that Allow to Identify Sites on the Internet, including by Redirecting to Other Domain Names, Whereas they may not be in the specified registry. If a redirect is detected from a blocked domain name to another domain name, Nethouse.id has the right to block access to such site without prior notice to the User.
4. The user is personally responsible for any information posted on the Site; such activity is carried out by the User at his own risk.
5. If the User does not agree with this Agreement or its updates, the User is obliged to refuse to use the services of the Site Administration.
Use of services and intellectual property rights
1. Nethouse trademark is registered in accordance with the law. The copyright holder of the Nethouse trademark, as well as texts, slogans, images, audiovisual works and other content posted on the nethouse.ru website, is Konstruktor Limited Liability Company. Any use of the Nethouse trademark, as well as the above results of intellectual activity on the Internet, is allowed only with the consent of the copyright holder. The use of the Nethouse trademark image, the Nethouse name, including transliteration in Russian, as well as the above results of intellectual activity by any means, including their placement on the Internet, in print and other media without approval, is considered as a violation of the rights to the trademark. sign and results of intellectual activity of the Site Administration.
2. All objects posted on the Site, including design elements, text, graphics, illustrations, videos, scripts, programs, music, sounds and other objects and their collections (Content), are subject to the exclusive rights of the persons who posted the data objects; all rights to these objects are reserved.
3. Except as provided by this Agreement, as well as applicable law, no Content may be copied (reproduced), processed, distributed, published, downloaded, transferred, sold or otherwise used in whole or in part without the prior permission of the copyright holder, except cases where the copyright holder has expressly agreed to the free use of the Content by any person.
4. The User, by posting on the Site the Content legally owned by him, grants other users, as well as other third parties, a non-exclusive right to use it by viewing, reproducing (including copying), processing (including printing copies) and other rights solely for the purpose of personal non-commercial use, unless such use causes or may cause harm to the legally protected interests of the right holder.
5. The use by the User of Content accessed exclusively for personal non-commercial use is allowed provided that all signs of authorship (copyrights) or other notices of authorship are preserved, the author's name is preserved unchanged, the work is preserved unchanged.
6. In addition to its own Content, the User is not entitled to upload or otherwise make public (publish on the Site) the Content of other sites, databases and other results of intellectual activity in the absence of the express consent of the copyright holder to such actions.
7. Any use of the Site or the Content, other than as permitted in this Agreement or in the case of the express consent of the copyright holder to such use, without the prior written permission of the copyright holder, is strictly prohibited.
8. Except as otherwise expressly provided in this Agreement, nothing in this Agreement shall be construed as a transfer of exclusive rights to the Content.
9. The User is personally responsible for any Content or any other information that he uploads or otherwise makes public (publishes) on the Site or with its help. The User does not have the right to upload, transfer or publish Content on the Site if he does not have the appropriate rights to perform such actions, acquired or transferred to him in accordance with the legislation of the Russian Federation.
10. Nethouse.id may, but is not obligated to, review the Site for prohibited Content and may remove or move (without notice) any Content or users in its sole discretion, for any or no reason, including, without limitation, removal or removal Content that, in the personal opinion of the Administration, violates these Rules, the legislation of the Russian Federation and / or may violate the rights, harm or threaten the safety of other Users or third parties.
11. By posting your Content on the Site, the User grants the Administration the right to make copies of his Content in order to streamline and facilitate the publication and storage of user Content on the Site.
12. By posting your Content in any part of the Site, the User automatically grants the Administration, free of charge, a non-exclusive right to use it by copying, public performance, reproduction, processing, translation and distribution for the purposes of the Site or in connection with them, including for its promotion. For these purposes, the Administration may produce derivative works or insert User Content as components in the relevant collections, perform other actions that serve to achieve these goals.
13. A link to any site, product, service, any information of a commercial or non-commercial nature posted on the User's page does not constitute an endorsement or recommendation of these products (services) by Nethouse.id.
14. This Agreement establishes the rules and conditions under which the rights to use information and results of intellectual activity (including literary, musical, audiovisual works and phonograms, works of graphics and design, photographic works, programs, but not limited to the above) as part of individual sections of the Site may belong to Users of the Site and other persons who independently created and / or placed these objects on the Site without the direct participation of Nethouse.id.
Disclaimer
1. Users are responsible for their own actions in connection with the creation and placement of information on their pages and in other sections of the Site. Violation of this Agreement and the law entails civil, administrative and criminal liability.
2. Nethouse.id provides the technical ability to use the services by the Users, does not participate in the formation of the content of the Users pages, does not control and is not responsible for the actions or omissions of any persons in relation to the use of the created pages and the Site or the formation and use of the content of the Users pages.
3. In the information system of the Site and its software, there are no technical solutions that automatically censor and control the actions and information relations of Users regarding the use of the Site and created pages.
4. Nethouse.id reserves the right at any time to change the design of the Site, its content, list of services, change or supplement the scripts used, software and other objects used or stored on the Site, any server applications at any time with prior notice or without it.
5. Nethouse.id does not pre-moderate or censor User information and takes action to protect the rights and interests of individuals and ensure compliance with legal requirements only after the request of the person concerned.
6. Nethouse.id is not responsible for the violation of this Agreement by the User and reserves the right, at its own discretion, as well as upon receipt of information from other users or third parties, including Roskomnadzor and the judiciary, about a violation of the legislation of Russia or this of the Agreement, modify (moderate) or delete any information published by the User that violates the prohibitions established by law, court or this Agreement (including private messages), suspend, restrict or terminate the User's access to all or any of the sections or services of the Site at any time by for any reason or without explanation, with or without prior notice, without being liable for any harm that may be caused to Users by such action. Nethouse.id reserves the right to remove the User's page and/or suspend, restrict or terminate the User's access to any of the Site's services if the Administration finds that, in its opinion, the User poses a threat to the Site and/or its Users. Nethouse.id is not responsible for the temporary blocking or deletion of information, or deletion of the page (termination of registration) of the User, carried out in accordance with this Agreement, including does not reimburse the User for the costs incurred by him to create and/or promote the site.
7. If the User violates the terms of the User Agreement, Nethouse.id has the right, at its own discretion, to block or delete the User's page and refuse the User to provide the Services.
8. Nethouse.id ensures the operation and performance of the Site and undertakes to promptly restore its performance in the event of technical failures and interruptions. Nethouse.id is not responsible for temporary failures and interruptions in the operation of the Site and the loss of information caused by them. The Administration is not responsible for any damage to the computer of the User or another person, mobile devices, any other equipment or software caused by or associated with downloading materials from the Site or via links posted on the Site.
9. Nethouse.id has the right to dispose of statistical information related to the functioning of the Site, as well as information of Users to ensure targeted display of advertising information to various audiences of Users of the Site. For the purposes of organizing the functioning and technical support of the Site and the execution of this Agreement, Nethouse.id has the technical ability to access the Users' pages, which it implements only in cases established by this Agreement.
10. Nethouse.id has the right to send the User information about the development of the Site and its services, as well as advertise its own activities and services.
11. Under no circumstances shall Nethouse.id or its representatives be liable to the user or to any third parties for any indirect, incidental, unintentional damages, including lost profits or lost data, damage to honor, dignity or business reputation caused in connection with using the Site, the contents of the Site or other materials to which the User or other persons have accessed through the Site, even if Nethouse.id warned or indicated the possibility of such harm.
12. The user is responsible for the damage caused as a result of illegal actions (omissions), in the double amount of the actually caused damage. The User agrees that damages include court decisions related to the User's use of Nethouse services.
13. The cost, procedure and terms for the provision of services are described and indicated in the relevant sections of the Site.
Personal data processing policy
1. Data processing and Nethouse.id's policy regarding the processing of personal and confidential data is carried out in accordance with the GDPR and the laws of Russia. Additional information and the use of User data are posted on the Nethouse Privacy Center portal.
2. By accepting this Agreement by registering on the Nethouse.id Website, the User confirms his consent to the processing by Nethouse.id of his personal data provided during registration, as well as placed by the User voluntarily on his page. The processing of the User's personal data is carried out in accordance with the legislation of the Russian Federation. Nethouse.id processes the User's personal data in order to provide services to the User. Nethouse.id takes all necessary measures to protect the User's personal data from unauthorized access, modification, disclosure or destruction. Nethouse.id has the right to use the information provided by the User, including personal data, in order to ensure compliance with the requirements of the current legislation of the Russian Federation (including for the purpose of preventing and/or suppressing illegal and/or unlawful actions of Users). Disclosure of the information provided by the User can be made only in accordance with the current legislation of the Russian Federation at the request of the court, law enforcement agencies, as well as in other cases provided for by the legislation of the Russian Federation.
3. The user, when filling out the registration form on the Site or by checking a special form confirming consent to the processing of personal data, or by clicking the 'Registration' button and indicating his data, in accordance with Art. 9 of the Federal Law of July 27, 2006 No. 152-FZ 'On Personal Data', gives his consent to the processing and use of his personal data.
4. The user confirms that all the data specified by him belongs to him personally, confirms and acknowledges that he has carefully and fully read this Policy and the Consent on the processing of personal data.
5. The consent given by the User to the Site is complete and unconditional.
6. The User's consent is signed with an electronic signature by registering on the Site and taking an action to accept the terms of this Agreement and the provisions of the Personal Data Processing Policy. The user agrees that the consent provided in electronic form is a consent that fully meets the requirements of the legislation on personal data and allows you to confirm the fact that it was received by the Site.
7. The consent given by the User to the processing of personal data may be revoked by sending a written application to the location of the Site, or to the e-mail address indicated on the Site, or by deleting the account on the Site. The User also agrees that the withdrawal of consent to the processing of personal data will automatically mean the removal of the User's account from the Site and termination of access to the services of the Site.
8. Consent is given for a period determined by the term of execution of the User Agreement.
9. Nethouse.id identifies threats to the security of personal data during their processing, forms threat models based on them. Nethouse.id develops a personal data protection system based on the threat model, which ensures the neutralization of suspected threats.
10. The protection of personal data is carried out using physical, technical and administrative measures aimed at preventing the risk of loss, misuse, unauthorized access, breach of confidentiality and data alteration.
11. Security measures include firewall and data encryption, control of physical access to data centers and cloud storage, and control of access rights to User data.
Payment for services and recurring payments (subscription)
1. In order to use the paid services of Nethouse.id, you must provide your bank card details for payment. If you have not canceled your subscription before the payment date, you authorize Nethouse.id to charge you a recurring fee for subscription services (subsequent period), accesses, options, connections using a bank card. Regular payments (subscription) provide the User with the opportunity to continuously use Nethouse.id and buy services, buy Nethouse points automatically without re-providing bank card data. When a subscription is connected, regular automatic transfers of funds from a bank card (Regular payments or subscription) of the User in favor of Nethouse.id are carried out on the basis of the User's prior acceptance in accordance with the offer on the Site and the terms of the Nethouse.id User Agreement.
2. Indicating bank card details and making a confirmed and undisputed payment by the User is consent to Regular Payments - automatic transfer of funds from a bank card specified by the User. Connection is available only for a bank card activated and confirmed by the User in Nethouse.
3. Automatic debiting of funds from the User's bank card is carried out by the Bank issuing the card.
4. Nethouse.id does not store or process the User's bank card data.
5. The site administration under no circumstances guarantees the possibility of making regular payments and operations using the User's bank card.
6. The user guarantees that he is the holder of a bank card, consciously, correctly and completely enters all the required bank card details when connecting the automatic renewal of the services used. If, for automatic transfer of funds, the User has connected a bank card, the holder of which he is not, the administration, at its discretion, has the right to demand from the holder of the bank card or the User to pay a fine in the amount of 50,000 (fifty thousand) rubles in favor of Nethouse.id. This fine is justified by the rules of payment systems and banks, according to which a bank card is an exclusively personal means of payment.
7. You can unsubscribe from Nethouse.id at any time. If you cancel your subscription, your account may be automatically closed at the end of the current billing period, and until then you will have access to the services. We do not provide refunds or credits for partially unused service periods or unreceived Nethouse.id service. To cancel your subscription, please contact support and follow the instructions.
8. Protesting a Standing Order payment by bank card or requesting a refund through the card issuing bank after receiving the service or replenishing the balance may be considered a violation by the User of payment obligations. The site administration has the right to challenge the User's claim to the card issuing bank and block the User's access to Nethouse.id services without refunding the funds.
9. The cost and term of service connection is determined by the offer on the Nethouse.id Website.
10. The refund is made within 10 (ten) days to the bank account at the User's written request. Refunds are made minus Nethouse.id's expenses for paying commissions from banks and payment systems.
11. The User's payment for connecting additional services, options, subscription packages is not returned to the User.
Other provisions
1. Nethouse.id in this Agreement and other special documents posted on the Site means Limited Liability Company 'Designer', a legal entity established under the laws of the Russian Federation and registered at: 197374, St. Petersburg, Torfyanaya Doroga, d. 7, lit. F.
2. Appeals, suggestions and claims of individuals and legal entities to Nethouse.id in connection with the execution of the Agreement and all issues related to the operation of the Site, violations of the rights and interests of third parties when using it, as well as requests from persons authorized by the legislation of the Russian Federation may be sent to mailing address: 197374, St. Petersburg, PO Box Nethouse.
3. The relations between the Parties may be additionally regulated by separate documents and agreements regulating the use of the relevant Service and/or the provision of services to the User. The application of such additional documents and agreements does not invalidate this Regulation.
4. This Agreement is governed by and construed in accordance with the laws of the Russian Federation. Issues not regulated by the Agreement shall be resolved in accordance with the legislation of the Russian Federation.
5. In the event of any disputes or disagreements related to the execution of this Agreement, the User and Nethouse.id will make every effort to resolve them through negotiations between them. In the event that disputes are not resolved through negotiations, disputes are subject to resolution in the manner prescribed by the current legislation of the Russian Federation, at the location of the Site Administration.
6. This Agreement comes into force for the User from the moment of its accession to it and is valid for an indefinite period.
7. This Agreement is written in Russian and may be provided to the User for review in another language. In case of discrepancy between the Russian-language version of the Agreement and the version of the Agreement in another language, the provisions of the Russian-language version of this Agreement shall apply.
8. This Agreement may be terminated at the initiative of Nethouse.id for violation by the User of the Agreement, the law, or at the request of the state authorities of Russia.
9. If, for one reason or another, one or more provisions of this Agreement are declared invalid or unenforceable, this does not entail the invalidity or inapplicability of the remaining provisions.

User agreement
